Please read this text carefully. Whether you are already a “friend of EFA” or you are considering becoming one, it is equally important to set things out clearly, for you and for us. For this reason, we have tried as much as possible to summarize the “rules” that apply to this platform. Besides being a legal obligation, it is in your and our respective interest to clarify certain things. We will do our best to offer you the best possible experience and we wish to make every “friend of EFA” feel like they are part of our big family. Please get in touch with us if something is not clear or not clear enough.

These terms and conditions (“Terms”, “Agreement”) are an agreement between the website operator (“Website Operator”, “EFA”, “the European Free Alliance, “us”, “we” or “our”) and you (“User”, “you” or “your”).

The Website Operator is the European political party European Free Alliance (“EFA”), registered under the number EUPP 6 BE 0866.016.691 in the register of the European political parties and foundations. The European Free Alliance has its legal seat in Belgium in Rue de la Pépinière 1 Boomkwekerijstraat – 1000 Brussels.

This website is funded with the support of the European Parliament. The content of this website does not reflect the official opinion of the European Parliament. Responsibility for the information and views expressed lies entirely with the author(s).

This Agreement sets forth the general terms and conditions of your use of the website using the URL “http://www.selfdetermination.world”, which includes any page of the website, associated application(s), and service we offer, the affiliation to the network “Friend of EFA” and any of its products or services (collectively, “Website”, “Platform” or "Services").

The Platform is supervised by Moderators and Administrators.

  1. Accounts and membership
    1. You must be at least 16 years of age to use this Website and to become a “Friend of EFA”.
    2. By using this Website, joining the network of the “Friends of EFA” and by agreeing to this Agreement you warrant and represent that you are at least 16 years of age.
    3. A request for membership implies the acceptance of the present Agreement and the Internal Rules of the Friends of EFA, as well as the agreement to abide by the decisions taken by the bodies of EFA.
    4. Membership is granted to all individuals committed to respecting the principles on which the Union is founded and the aims and objectives of the EFA.
    5. Membership as a Friend of EFA shall serve to support the EFA and, to this end, the individual commits to not take any actions that might directly or indirectly damage or pose a threat to the EFA, its members, its political foundation (Coppieters Foundation), its youth branch (EFAy) and their interests.
    6. You understand that creating a profile in this Platform affiliates you as individual supporter of the European Free Alliance.
    7. You may resign at any time.
    8. Failing to renew the membership and paying the annual contribution is equivalent to a resignation.
    9. You may notify your intention to resign to legal@selfdetermination.world .
    10. The resignation will be effective as from the moment your request is received.
    11. Membership is obtained through the registration in the Platform and the payment of an annual fee of Fifty (50,00) Euros.
    12. The membership in Friends of EFA and your profile in this Platform are strictly and exclusively personal and non-transferrable under any circumstance, including but not limited to death.
    13. The membership fee shall be paid at the moment the membership is requested and is the necessary condition to the approval of a membership request.
    14. The use of the Platform is subject to the payment of the annual fee.
    15. The amount of the membership fee is determined and approved each year by the General Assembly of EFA.
    16. If we implement a new or modified fee, we will give you advanced notice such as by posting changes on our Platform or sending you an email.  
    17. All fees and all transactions are denominated or converted in Euro.
    18. If we suspend, disable or delete your account in connection with violation of this Agreement or the Internal Rules of the Friends of EFA we are not obligated to refund any fees paid.
    19. Members of the Friends of EFA cannot claim the return or dispose of the amounts paid as membership fees.
    20. In case of resignation, a member cannot claim the return of the amounts paid as membership fees.
    21. All the amounts paid as membership fees are the sole property of the European Free Alliance EUPP.
    22. You authorize us (and our designated third-party payment processor) to charge your designated payment method for the total amount of any fees you owe.
    23. If the payment method cannot be verified, is invalid, or is otherwise not acceptable to us, your payment may be suspended or cancelled.
    24. We reserve the right to correct, or to instruct our payment processors to correct, any errors or mistakes, even if payment has already been requested or received.
    25. We also may issue refunds, or instruct our payment processors to issue refunds, if in accordance with this Agreement, the Internal Rules of the Friends of EFA, the Statutes or the Rules of Internal Order of EFA, at our sole discretion.
    26. To request a refund, you need to substantiate your request and address it to legal@selfdetermination.world .
    27. Fees are billed on either a recurring basis or on a one-time basis.
    28. If billed on a recurring basis, the fees are payable in advance of the applicable period specified via the Platform with no refunds.
    29. We will automatically bill you for each renewal period until cancellation.
    30. You authorize us to keep your payment current by charging your credit card account, or any other means of payment used by you, the applicable fee.
    31. While you may cancel auto-renewal or cancel your subscription at any time, you won’t be issued a refund except to our sole discretion.
    32. If you create an account on the Platform, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it.
    33. You must immediately notify us of any unauthorized uses of your account or any other breaches of security.
    34. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.
    35. We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any provision of this Agreement or that your conduct or content would tend to damage our reputation and goodwill.
    36. Your account can also be suspended, disabled or deleted following a decision of EFA which determines a violation of the internal rules of the Friends of EFA.
    37. Providing false contact information of any kind may result in the termination of your account.
    38. A member who has the ability to moderate or manage the Platform also has the ability to suspend your access to the Platform and give immediate communication of the suspension to the Administrator.
    39. The Administrator confirms or rejects any suspension made by a moderator within 48 hours from the notification of the suspension.
    40. If we delete your account for the aforementioned reasons, you may not re-register for our Services.
    41. We may block your email address and any Internet protocol address associated with your account to prevent further registration.
  2. Privacy
    1. EFA collects registration and other information about you through the Platform.
    2. Please refer to our Privacy Policy for details on how we collect, use, and disclose this information.
    3. These policies do not govern use of information that you provide to third parties, such as other members of the Platform.
    4. EFA has no control over how other members may use information that you provide to them, so you should exercise common sense and sound judgement when sharing information with others on our Platform.
  3. User content
    1. This platform enables you and other members to create on-line discussions, events and polls.
    2. Search engines can see only public areas of the Platform.
    3. Our Platform is designed so that search engines cannot see your Content that is within restricted areas of the Platform.
    4. We do not own any data, information or material ("Content") that you submit on the Platform in the course of using the Service.
    5. You shall have sole responsibility for the accuracy, quality, integrity, legality, reliability, appropriateness, and intellectual property ownership or right to use of all submitted Content.
    6. We may monitor Content on the Platform submitted or created using our Services by you.
    7. Unless specifically permitted by you, your use of the Platform does not grant us the license to use, reproduce, adapt, modify, publish or distribute the Content created by you or stored in your user account for commercial, marketing or any similar purpose.
    8. You hereby grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable, transferable right and license (including a waiver to the maximum possible extent of any moral rights) to access, copy, distribute, store, transmit, reformat, host, reproduce, modify, publish, publicly display, publicly perform, and create derivative works of, your Content of your user account solely as required for the purpose of providing the Services to you and for any other permitted use defined in this Agreement.
    9. Without limiting any of those representations or warranties, we have the right, though not the obligation, to our own sole discretion, to refuse or remove any Content that, in our reasonable opinion, violates any of our policies or is in any way harmful or objectionable.
  4. Backups
    1. We perform regular backups of the Platform and Content and will do our best to ensure completeness and accuracy of these backups.
    2. In the event of a hardware failure or data loss we will restore backups automatically to minimize the impact and downtime.
  5. Links to other Platforms
    1. Although this Platform is linked to the websites of the Coppieters Foundation and of the European Free Alliance Youth, any link published directing to other websites, are not, directly or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with any linked website, unless specifically stated herein.
    2. We are not responsible for examining or evaluating, and we do not warrant the offerings of, any businesses or individuals or the content of any third platform.
    3. We do not assume any responsibility or liability for the actions, products, services, and content of any other third-parties. You should carefully review the legal statements and other conditions of use of any website which you access through a link from this Platform.
    4. Your linking to any other off-site websites is at your own risk.
  6. Prohibited uses
    1. In addition to other terms as set forth in the Agreement, you are prohibited from using the Platform or its Content:
    2. for any unlawful purpose;
    3. to solicit others to perform or participate in any unlawful acts;
    4. to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances;
    5. to infringe upon or violate our intellectual property rights or the intellectual property rights of others;
    6. to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate;
    7. to submit false or misleading information;
    8. to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet;
    9. to collect or track the personal information of others;
    10. to spam, phish, pharm, pretext, spider, crawl, or scrape;
    11. for any obscene or immoral purpose; or
    12. to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet.
    13. We reserve the right to terminate your use of the Platform or any related service for violating any of the prohibited uses.
  7. Intellectual property rights
    1. This Agreement does not transfer to you any intellectual property owned by the Platform Operator or third-parties, and all rights, titles, and interests in and to such property will remain (as between the parties) solely with Platform Operator.
    2. All trademarks, service marks, graphics and logos used in connection with our Platform or Services, are trademarks or registered trademarks of Platform Operator or Platform Operator licensors.
    3. Other trademarks, service marks, graphics and logos used in connection with our Platform or Services may be the trademarks of other third-parties.
    4. Your use of our Platform and Services grants you no right or license to reproduce or otherwise use any Platform Operator or third-party trademarks.
  8. Limitation of liability
    1. To the fullest extent permitted by applicable law, in no event will the Platform Operator, its affiliates, members, officers, directors, employees, agents, suppliers or licensors be liable to any person for any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use or content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if Platform Operator has been advised as to the possibility of such damages or could have foreseen such damages.
    2. You agree that in no event shall EFA or any of its affiliates, members, officers, directors, employees, agents, suppliers or licensors be liable for any direct, indirect, incidental, special, or consequential damages, arising out of or in connection with transactions with any member or third party on the Platform, your transportation to or from EFA events, attendance at EFA events, participation in or exclusion from groups or events and the actions of you or others at the events.
    3. To the maximum extent permitted by applicable law, the aggregate liability of the Platform Operator and its affiliates, members, officers, employees, agents, suppliers and licensors, relating to the services, payable to you or any third parties in any circumstance is limited to the greater of the amount of fees, if any, you paid to us in the twelve (12) months prior to the action that may give rise to liability and shall be limited to the amount of fifty Euro (€50), regardless of any amounts actually paid by you.
    4. The limitations and exclusions also apply if this remedy does not fully compensate you for any losses or fails of its essential purpose.
    5. You further waive to the maximum extent permitted by applicable law any and all rights and benefits otherwise conferred by any law of any jurisdiction that would purport to limit the scope of this Agreement and specifically our limitation of liability.
    6. You waive and relinquish all rights and benefits that you have or may have under any other jurisdiction to the fullest extent permitted by law.
  9. Indemnification
    1. You agree to indemnify and hold the Platform Operator and its affiliates, directors, officers, employees, and agents harmless from and against any liabilities, losses, damages or costs, including reasonable attorneys’ fees, incurred in connection with or arising from any third-party allegations, claims, actions, disputes, or demands (“Claims”) asserted against any of them as a result of or relating to your Content, your use of the Platform or Services or any wilful misconduct on your part.
    2. You agree to promptly notify us of any third-party Claims, cooperate with EFA in defending such Claims and pay all fees, costs and expenses associated with defending such Claims (including, but not limited to, attorneys’ fees).
    3. You agree not to settle any Claim without our prior written consent.
  10. Severability
    1. All rights and restrictions contained in this Agreement may be exercised and shall be applicable and binding only to the extent that they do not violate any applicable laws and are intended to be limited to the extent necessary so that they will not render this Agreement illegal, invalid or unenforceable.
    2. If any provision or portion of any provision of this Agreement shall be held to be illegal, invalid or unenforceable by a court of competent jurisdiction, it is the intention of the parties that the remaining provisions or portions thereof shall constitute their agreement with respect to the subject matter hereof, and all such remaining provisions or portions thereof shall remain in full force and effect.
  11. Representation
    1. No agency, joint venture, employee-employer or franchiser-franchisee relationship between you and EFA is intended or created by this Agreement.
    2. A member of the Platform is not EFA's representative, agent or employee and may not enter into any agreement on EFA’s behalf.
  12. Dispute resolution
    1. Before making any claim, you and EFA agree to try to resolve any disputes through good faith discussions.
    2. You agree to resolve disputes with EFA on an individual basis.
    3. You or EFA may initiate this process by sending written notice describing the dispute and your proposed resolution.
    4. In the event that we cannot resolve the issue within 30 days of receipt of the initial notice, you or EFA may bring a claim in accordance with this Agreement and applicable law.
    5. The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of the judicial district of Brussels, Belgium without regard to the choice of law and, to the extent applicable, the laws of Belgium.
    6. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in Brussels, Belgium, and you hereby submit to the jurisdiction of such courts.
  13. Nature of the membership fee
    1. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.
    2. To the payment of the membership fee or to any other Service offered on the Platform shall not apply any commercial law of any jurisdiction or any other commerce regulatory disposition.
    3. The membership fee shall be considered as a contribution to the European Free Alliance as defined in the Article 2(8) of the Regulation (EU, Euratom) No 1141/2014 of the European Parliament and of the Council of 22 October 2014 on the statute and funding of European political parties and European political foundations.
  14. Changes and amendments
    1. We reserve the right to modify this Agreement or its policies relating to the Platform or its Services at any time, effective upon posting of an updated version of this Agreement on the Platform.
    2. When we do we will post a notification on the main page of our Platform.
    3. Continued use of the Platform after any such changes shall constitute your consent to such changes.
  15. Acceptance of these terms
    1. You acknowledge that you have read this Agreement and agree to all its terms and conditions.
    2. By using the Platform or its Services you agree to be bound by this Agreement.
    3. If you do not agree to abide by the terms of this Agreement, you are not authorized to use or access the Platform and its Services.
    4. Our Platform is provided to you “as is” and on an “as available” basis.
  16. Language use
    1. This Agreement was written in English.
    2. This Agreement may be translated into other languages.
    3. If there is any inconsistency between the English version and a translated version, the English language version prevails.
